Keralite senior carer sacked and reported to DBS for sleeping while on night duty

LONDON Feb 28: A Keralite senior carer was dismissed and reported to DBS (Disclosure and Barring Service) for sleeping while on night duty at a care home in London. He was caught sleeping while on night duty on two occasions which the care home’s CCTV recorded.

He was a nurse in Kerala and was working as a senior carer in a care home in the UK.

A care home or a hospital can report a healthcare worker to DBS if they found they have done something wrong or that makes it dangerous for those who they look after.

The care home sacked him from his job and then reported him to DBS.

The DBS completed their enquiries and decided it is “appropriate and proportionate to include the senior carer in the Adults’ and Children’s Barred Lists”.

He cannot carry out any further work in the healthcare sector which involves protected adults and children.

It will be an offence for the senior carer to carry out or seek work from which he is barred.

If he is currently working with adults or children he should talk to his employer as soon as possible.

If he doesnt then others those who employ will be committing an offence if they knowingly engage this person in work from which he is barred from.

The reason for DBS adding him on the Adults and Children’s Barred list is because his conduct endangered a vunerable adult or was likely to endanger a vulnerable adult.

The senior carer claimed that he was tired and was forced to work for more hours in spite of him informing the care home that he was unwell.

He told DBS that he had fever and back pain and that he was taking some rest sitting on the chair and not sleeping and just taking some rest.

DBS couldnt take into account his argument of his illness as there were no proofs for it in the form of a sick note or any entry in the care home records.

He can now appeal the DBS decision to the Upper Tribunal.

He can also take legal assistance and also seek help from union representative to help assist him in the process.

It is a lesson learnt that newly arrived migrants should be careful at work as errors like this can cost their career which they have built with years of learning and hardwork.
